Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Realty Prep (the "Developer", "we", "us") governing your use of the Realty Prep iOS application (the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial use, and in accordance with the Apple Media Services Terms and Conditions and the Apple standard EULA.
2. Restrictions
You agree that you will not:
- Copy, modify, distribute, sell, rent, lease, or create derivative works of the App or its content, including the question bank and explanations;
- Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent such restrictions are prohibited by applicable law;
- Share your account credentials with others, or use automated tools to access the App;
- Use the App to infringe the rights of others or for any unlawful purpose;
- Reproduce, scrape, or redistribute our practice questions or explanations in any form, for any purpose, without our written permission.
3. Subscriptions and purchases
The App offers optional in-app purchases and auto-renewing subscriptions that unlock additional content and features ("Pro"). Purchases are processed by Apple via the App Store using your Apple ID.
- Auto-renewal: Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the period.
- Managing subscriptions: You can manage, upgrade, downgrade, or cancel your subscription at any time in iOS Settings → [your name] → Subscriptions.
- Free trials: If a free trial is offered, it will convert to a paid subscription at the end of the trial period unless canceled beforehand.
- Refunds: All purchases are handled by Apple and subject to Apple's refund policies. Contact Apple Support for refund requests.
- Price changes: We may change subscription prices. You will be notified of any price change before it takes effect, and your continued use after the change constitutes acceptance of the new price.
4. Study content disclaimer
Realty Prep is a study aid, not an official test. The App is not affiliated with, endorsed by, or sponsored by the California Department of Real Estate (DRE). All questions are original practice items written for exam preparation based on publicly available DRE reference materials and California statutes. They are not official DRE exam questions.
We make no guarantee, warranty, or representation that using the App will result in passing the DRE salesperson or broker examination, or any other licensing exam. Exam results depend on many factors outside our control, including your study effort, test-day performance, and any changes the DRE makes to its exam content.
The App does not provide legal, financial, or professional advice. Information in the App should not be relied on as a substitute for consulting a licensed attorney, accountant, or other qualified professional.
5. No warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ALL CONTENT IS ACCURATE OR UP TO DATE.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL REALTY PREP OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TWENTY U.S. DOLLARS ($20), WHICHEVER IS GREATER.
7. Indemnification
You agree to indemnify and hold harmless Realty Prep from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the App.
8. Apple as third-party beneficiary
You acknowledge that these Terms are between you and Realty Prep only, and not with Apple Inc. Apple is not responsible for the App or its content. However, Apple is a third-party beneficiary of these Terms and may enforce them against you. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
9. Export compliance
You may not use or export the App except in compliance with U.S. law and the laws of the jurisdiction in which the App was obtained.
10. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms. You may stop using the App and delete your account at any time from within the app.
11. Changes to these Terms
We may update these Terms from time to time. The effective date at the top of this page will be updated. Your continued use of the App after changes constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App will be resolved in the state or federal courts located in California.
